These Terms of Use (“Terms”) govern your access to and use of the Function mobile application, the Function website, and related services (collectively, the “Services”).
The Services are operated by Excalibur Innovations LLC (“Function,” “we,” “us,” or “our”).
Please read these Terms carefully. By creating an account, accessing, or using Function, you agree to these Terms and acknowledge our Privacy Policy.
If you do not agree to these Terms, do not use Function.
1. Eligibility
You must be at least 13 years old to create or use a Function account.
You may not use Function if you are prohibited from doing so under applicable law.
By using Function, you represent that:
- you meet the applicable minimum-age requirement;
- the information you provide is accurate to the best of your knowledge;
- you have authority to agree to these Terms; and
- your use of Function will comply with applicable laws and these Terms.
Function may impose a higher minimum age where required by applicable law.
2. Your Account
Function currently uses Sign in with Apple for authentication.
You are responsible for activity associated with your account and for maintaining control of the Apple account and devices you use to access Function.
You may not:
- impersonate another person or organization;
- create an account using information you are not authorized to use;
- sell, transfer, or improperly share access to your Function account;
- create accounts to evade blocking, moderation, restrictions, or enforcement.
You are responsible for keeping your profile information reasonably accurate.

3. What Function Does
Function is a social platform designed to help users discover, organize, join, and share information about real-world gatherings and activities, referred to within the Services as “Functions.”
Function may provide features including:
- user profiles;
- public and private Functions;
- RSVPs and attendance;
- groups;
- invitations and join requests;
- Function, group, and direct messaging;
- photo and video galleries;
- comments and reactions;
- social following;
- location and venue information;
- notifications and Live Activities;
- recommendations and discovery;
- reporting and blocking tools.
Function provides the software platform.
Except where expressly stated otherwise, Function does not organize, operate, supervise, sponsor, control, or guarantee user-created real-world events.
4. User-Hosted Functions and Events
Functions may be created by individual users or by users acting on behalf of groups.
Hosts are responsible for the information they provide, including:
- event title and description;
- date and time;
- location;
- capacity;
- admission or attendance expectations;
- privacy and join settings;
- updates or cancellations;
- compliance with applicable law.
Function does not independently verify every Function, host, location, description, attendance claim, or other event detail.
Information about a Function may be incomplete, inaccurate, changed, or canceled by its host.
You are responsible for evaluating whether attending or participating in a Function is appropriate for you.
5. Real-World Safety
Function helps users connect around real-world activities, but we do not control what occurs at those activities.
Participation in an in-person Function may involve risks that Function cannot predict or control.
You are responsible for exercising reasonable judgment regarding:
- where you go;
- who you meet;
- what information you share;
- transportation;
- alcohol or other substances;
- physical activities;
- venue safety;
- local laws;
- emergencies and other real-world circumstances.
Function is not an emergency service.
If you or another person is in immediate danger, contact local emergency services.
To the maximum extent permitted by law, Function is not responsible for the acts or omissions of hosts, attendees, group members, venues, or other third parties encountered through the Services.
6. Groups
Users may create or participate in groups on Function.
Groups may have owners, administrators, members, and followers, depending on the group’s configuration.
Users who manage a group are responsible for:
- content posted on behalf of the group;
- membership and administrative actions;
- group-hosted Functions;
- information represented as belonging to the group;
- complying with these Terms and applicable law.
A user acting on behalf of a group represents that they have permission to do so.
Official or Verified Groups
Function may display an “Official,” verified, or similar badge for certain groups.
Such a badge is a platform designation and does not, unless Function expressly states otherwise, constitute:
- government verification;
- identity verification;
- accreditation;
- endorsement;
- a guarantee of legitimacy;
- a guarantee that information provided by the group is accurate.
Users should exercise their own judgment when interacting with any group.
7. User Content
“User Content” means content submitted, uploaded, transmitted, created, or otherwise made available through Function by users.
User Content may include:
- names and profile information;
- Function listings;
- descriptions;
- group information;
- photos;
- videos;
- captions;
- comments;
- reactions;
- messages;
- invitations;
- location information;
- reports;
- other submitted material.
You Retain Ownership
As between you and Function, you retain ownership of intellectual-property rights you hold in your User Content.
These Terms do not transfer ownership of your User Content to Function.
License to Function
By submitting User Content to Function, you grant Excalibur Innovations LLC a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, process, modify for technical purposes, format, resize, compress, transcode, create thumbnails or technical derivatives of, display, distribute, and otherwise use that User Content solely as reasonably necessary to operate, provide, secure, moderate, improve, and promote the Function Services and the features through which you chose to share the content.
This license includes the ability to:
- store content using our service providers;
- display content to users authorized to view it;
- make media available through Function galleries and profiles;
- display public Function information on Function webpages or sharing experiences;
- generate thumbnails or optimized versions;
- transmit content through Function features such as sharing, notifications, or related service functionality.
This license does not transfer ownership of your User Content to Function.
The license ends when the relevant User Content is deleted from our systems, except to the extent that:
- the content has been shared with others and remains legitimately available to them;
- retention is necessary for safety, moderation, legal, backup, or operational purposes;
- the content forms part of a shared conversation or similar record;
- applicable law permits or requires continued retention.
Our Privacy Policy provides additional information regarding deletion and retention.
Your Responsibilities for User Content
You represent that you have the rights and permissions necessary to submit your User Content and grant the license described above.
You may not upload content that infringes another person’s:
- copyright;
- trademark;
- privacy;
- publicity rights;
- confidential information;
- contractual rights;
- other legal rights.
Do not upload another person’s private or sensitive information without appropriate authorization.
9. Messaging
Function may provide direct messages, group chats, and Function chats.
You are responsible for messages and media you send.
Do not use messaging to:
- harass or threaten others;
- send unwanted spam;
- distribute illegal material;
- conduct scams or fraud;
- share content you do not have the right to share;
- circumvent a user’s decision to block you.
Function messages are not end-to-end encrypted.
Function may process stored messages as described in the Privacy Policy for purposes such as operating the Service, support, security, moderation, abuse prevention, and legal compliance.
Deleting your account may not delete message text already shared with other users. Your identity may instead be anonymized in retained shared conversations.
10. Location Information
Function may provide features involving device location and user-provided event locations.
Hosts are responsible for venue and location information they submit.
Location information may be approximate, delayed, inaccurate, changed, or unavailable.
Do not rely on Function location features where precise or emergency-grade location information is required.
Function may allow hosts to control when and to whom certain event-location details are revealed.
You are responsible for deciding what location information you choose to submit or share.
11. Prohibited Conduct
You may not use Function to engage in conduct that is unlawful, harmful, abusive, deceptive, or inconsistent with the purpose of the Services.
Prohibited conduct includes, without limitation:
- harassment, bullying, stalking, intimidation, or threats;
- hateful or discriminatory abuse;
- exploitation or sexualization of minors;
- unlawful sexually explicit content;
- encouragement or facilitation of serious violence;
- illegal activity;
- fraud, scams, or deceptive schemes;
- false or intentionally misleading Function listings;
- impersonation;
- spam or abusive solicitation;
- infringement of intellectual-property rights;
- unauthorized disclosure of private or personal information;
- uploading media or content without appropriate rights;
- distributing malware or malicious code;
- attempts to compromise Function’s security;
- circumventing reports, blocks, moderation systems, access controls, or technical restrictions;
- using alternate accounts to contact users who have blocked you;
- scraping or automated extraction of Function data without authorization;
- unauthorized bots or automated access;
- reverse engineering or attempting to derive source code except where applicable law expressly permits it;
- interfering with the operation of the Services;
- using Function to create or promote real-world activities that are illegal or intentionally place others in serious danger.
You must also comply with applicable laws and any additional community or feature-specific rules presented within Function.
12. Content Moderation, Reports, and Blocking
Function provides tools designed to help users manage objectionable content and interactions.
These may include:
- automated or rule-based content filtering;
- user reports;
- user blocking;
- group blocking;
- content removal;
- other moderation actions.
Function may review, restrict, remove, preserve, or disable access to content when we reasonably believe it:
- violates these Terms;
- violates applicable law;
- creates a safety or security risk;
- infringes rights;
- is abusive, fraudulent, or harmful;
- threatens the operation or integrity of Function.
We do not guarantee that we will identify or remove every item of objectionable or unlawful content before it is viewed.
Reporting content does not guarantee a particular enforcement result.
Blocking is intended to help users control their own experience but may not eliminate every possible interaction in shared real-world settings or shared platform contexts.
13. Enforcement and Account Access
We reserve the right, subject to applicable law, to restrict, disable, terminate, or refuse access to accounts or Services where reasonably necessary to:
- enforce these Terms;
- protect users;
- address illegal or abusive conduct;
- protect Function or our systems;
- comply with legal obligations.
Function may also remove User Content or restrict features where appropriate.
Some enforcement may currently require manual administrative action.
Nothing in this section requires Function to maintain a particular moderation tool or enforcement interface.
14. Account Deletion
You may initiate deletion of your Function account through the app.
Deletion is subject to the actual structure of shared content and relationships within Function.
Account deletion may result in:
- deletion or anonymization of your profile;
- deletion of personally owned Functions where no other appropriate host remains;
- transfer or retention of co-hosted or group-hosted Functions where appropriate;
- deletion of media you uploaded;
- removal from groups and social relationships;
- anonymization of certain reports or moderation records;
- retention of shared message text for other conversation participants;
- retention of limited records where reasonably necessary for security, safety, legal, backup, dispute-resolution, or operational purposes.

15. Intellectual Property of Function
The Function application, website, software, design, branding, logos, graphics, interfaces, and other materials provided by Excalibur Innovations LLC, excluding User Content and third-party materials, are owned by or licensed to Excalibur Innovations LLC and are protected by applicable intellectual-property laws.
“Function,” Function branding, and related visual assets may not be used in a manner that falsely suggests sponsorship, endorsement, or affiliation without permission.
Nothing in these Terms transfers ownership of Function’s software or intellectual property to you.
16. Third-Party Content and Services
Function relies on or may interact with third-party services, including services provided by Apple, Google/Firebase, Vercel, mapping providers, and other technology providers.
Function may also contain links to third-party websites or services.
We do not control third-party services and are not responsible for their:
- availability;
- content;
- accuracy;
- security;
- privacy practices;
- terms;
- actions.
Your use of third-party services may be governed by additional terms between you and the applicable provider.
17. Apple App Store
If you download or use Function through Apple’s App Store, you acknowledge that these Terms are between you and Excalibur Innovations LLC, not Apple.
Your license to use the Function iOS application is also subject to the applicable Apple App Store usage rules and end-user license terms.
Unless a custom end-user license agreement is separately provided for Function through the App Store, Apple’s Standard Licensed Application End User License Agreement applies to the license for the iOS application.
Apple is not responsible for operating the Function service or for User Content made available through Function.
Nothing in these Terms is intended to conflict with rights or obligations that cannot lawfully be modified under Apple’s applicable terms.
18. No Current Fees or Payments
Function currently does not charge users for subscriptions, ticket purchases, paid group memberships, or other in-app transactions.
We may introduce paid products or services in the future.
If we do, additional terms, pricing information, and any legally required disclosures will be provided before those paid services apply to you.
19. Changes to the Services
Function is an evolving service.
We may add, modify, suspend, or discontinue features from time to time.
We may also perform maintenance or experience outages.
We do not guarantee that every feature will always remain available or operate without interruption.
Where required by law, we will provide appropriate notice of material changes affecting users’ rights.
20. Changes to These Terms
We may update these Terms from time to time to reflect changes to Function, our practices, or legal requirements.
When we make changes, we will update the “Last Updated” date.
If a change is material, we may provide additional notice or require renewed acceptance where appropriate or required by law.
Your continued use of Function after updated Terms become effective constitutes acceptance only to the extent permitted by applicable law.
21. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FUNCTION AND THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
EXCALIBUR INNOVATIONS LLC DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND QUIET ENJOYMENT, TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.
WE DO NOT WARRANT THAT:
- FUNCTION WILL ALWAYS BE AVAILABLE;
- THE SERVICES WILL BE ERROR-FREE;
- USER CONTENT IS ACCURATE;
- A FUNCTION WILL OCCUR AS DESCRIBED;
- A HOST OR ATTENDEE IS WHO THEY CLAIM TO BE;
- A GROUP BADGE GUARANTEES LEGITIMACY;
- A LOCATION IS SAFE;
- PARTICIPATION IN A REAL-WORLD FUNCTION WILL BE SAFE;
- ALL OBJECTIONABLE CONTENT WILL BE IDENTIFIED OR REMOVED.
Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
22. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EXCALIBUR INNOVATIONS LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF FUNCTION.
THIS INCLUDES, TO THE EXTENT PERMITTED BY LAW, DAMAGES ARISING FROM:
- USER-GENERATED CONTENT;
- INTERACTIONS WITH OTHER USERS;
- REAL-WORLD FUNCTIONS OR EVENTS;
- HOST OR ATTENDEE CONDUCT;
- INACCURATE EVENT OR LOCATION INFORMATION;
- LOSS OF CONTENT OR DATA;
- UNAUTHORIZED ACCOUNT ACCESS;
- SERVICE INTERRUPTION;
- THIRD-PARTY SERVICES.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
23. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Excalibur Innovations LLC and its officers, members, employees, contractors, and agents from claims, liabilities, damages, losses, and reasonable costs arising from:
- your User Content;
- your violation of these Terms;
- your violation of applicable law;
- your infringement of another person’s rights;
- a Function or group you create, operate, or administer;
- your conduct in connection with the Services.
This section does not require indemnification to the extent prohibited by applicable law.
24. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles, except to the extent applicable law requires otherwise.
Any dispute that is not subject to a mandatory alternative dispute process imposed by applicable law may be brought in a court of competent jurisdiction in Texas, subject to applicable jurisdiction and venue requirements.
Nothing in these Terms deprives a consumer of protections that cannot lawfully be waived under the laws applicable to that consumer.
25. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the maximum extent permitted by law.
The unenforceable provision will be interpreted or limited only as much as necessary to make it enforceable where permitted.
26. No Waiver
If we do not enforce a provision of these Terms in a particular instance, that does not waive our right to enforce it later.
27. Entire Agreement
These Terms, together with the Function Privacy Policy and any additional terms expressly presented for a particular feature, constitute the agreement between you and Excalibur Innovations LLC regarding the Function Services, except for separate terms that govern third-party services or the license to the iOS application through Apple’s App Store.
